Waste Collection Sutton Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Sutton provides waste collection and related services to residential and commercial customers. By placing a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, organisation or other entity that requests or pays for the waste collection service.

Service means any waste collection, removal, transportation, loading, clearing, recycling, or disposal service carried out by or on behalf of Waste Collection Sutton.

Waste means the materials, rubbish, junk, refuse or other items that the Customer instructs Waste Collection Sutton to remove as part of the Service, subject always to applicable waste regulations.

Contract means the agreement between the Customer and Waste Collection Sutton for the supply of Services, made up of these Terms and Conditions and the specific details of your booking.

2. Scope of Service

Waste Collection Sutton provides waste collection and related services within its defined service area, which may be updated from time to time. The Service generally includes the loading and removal of Waste from the agreed collection point and the transport of such Waste to a licensed facility for treatment, recycling or disposal in accordance with applicable laws.

We reserve the right to decline to collect certain items where doing so would be unsafe, unlawful, or outside the scope of the Service. This includes but is not limited to hazardous materials, clinical or medical waste, chemicals, asbestos, gas bottles, and other controlled or prohibited wastes under UK regulations.

3. Booking Process

3.1 Bookings may be made by telephone, email, or via any online booking facility we may provide. By making a booking, the Customer confirms that they are at least 18 years of age and have authority to enter into the Contract and arrange for the removal of Waste from the specified premises.

3.2 When placing a booking, the Customer must provide accurate and complete information, including:

• The full address and access details for the collection location.

• A clear and honest description of the type, volume, and approximate weight of the Waste.

• Any known risks or restrictions affecting access, parking or loading.

3.3 We will provide an estimate or quotation based on the information supplied. This may be a fixed price or a price range. The final price may be adjusted on arrival if the actual Waste or conditions differ materially from the description given at the time of booking.

3.4 A booking is only confirmed when we have accepted it and provided a booking confirmation, which may be verbal, by email, or by message. We reserve the right to refuse any booking at our sole discretion.

4. Access and Customer Obligations

4.1 The Customer must ensure that our team has safe, reasonable, and lawful access to the Waste at the agreed time. This includes arranging any necessary permissions, providing accurate directions, ensuring that access routes are clear, and that parking is available where reasonably possible.

4.2 The Customer is responsible for ensuring that the Waste to be removed is clearly identified and separated from any items that are not to be taken. Our team may request confirmation on site before loading.

4.3 If we are unable to carry out the Service due to inadequate access, restricted parking, unsafe conditions, or where the Waste does not match the description provided, we may cancel the visit or offer to proceed at an adjusted price. In such cases, a call-out or cancellation charge may apply.

5. Pricing and Payments

5.1 Our charges are based on factors including the type and quantity of Waste, the time required, labour involved, and any disposal or recycling fees. Prices will be quoted in pounds sterling and may be subject to VAT and other applicable taxes.

5.2 Unless agreed otherwise, payment is due immediately upon completion of the Service on site. We may accept payment by cash, debit card, credit card or other approved methods. For business and account Customers, alternative payment terms may be agreed in writing.

5.3 Where a deposit or prepayment is requested as a condition of booking, the booking will not be confirmed until the deposit is received and cleared. Deposits may be non-refundable in certain circumstances, as specified in these Terms and Conditions.

5.4 If additional Waste is presented for collection on arrival that was not included in the original quotation, or if the type of Waste or access conditions differ significantly, we may revise the price before commencing work. If you do not accept the revised price, we may cancel the Service and a call-out fee may apply.

5.5 For Customers with agreed credit terms, invoices must be paid in full by the due date stated on the invoice. We reserve the right to charge interest and late payment fees on overdue amounts in accordance with applicable UK legislation.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting us using the same method by which the booking was made, or by any other method we specify.

6.2 Where a booking is cancelled by the Customer more than 24 hours before the agreed collection time, any deposit may be refunded, less any reasonable administrative costs. Where a booking is cancelled less than 24 hours before the agreed time, we reserve the right to retain all or part of any deposit and/or to charge a cancellation fee to cover costs incurred.

6.3 If our team attends the site at the agreed time and is unable to carry out the Service because of circumstances outside our control, including lack of access, insufficient parking, unsafe conditions, or the Customer’s failure to be present where required, we may treat this as a late cancellation and charge a call-out or cancellation fee.

6.4 We may cancel or reschedule a booking at any time due to reasons including but not limited to vehicle breakdowns, staff shortages, severe weather, safety concerns, or other circumstances beyond our reasonable control. In such cases, we will aim to inform the Customer as soon as reasonably practicable and to arrange an alternative appointment. We will not be liable for any loss arising from such cancellation or rescheduling, save for refunding any prepayments for Services not provided.

7. Performance of the Service

7.1 Our team will use reasonable skill and care when performing the Service. We will endeavour to arrive within the agreed time window, but any times quoted are estimates only and are not guaranteed. Delays may occur for reasons outside our control.

7.2 We will take reasonable steps to minimise disruption and avoid damage to the Customer’s property while carrying out the Service. However, it is the Customer’s responsibility to protect or remove any items that may be vulnerable to damage during the removal process.

7.3 Our team may refuse to handle or remove any items that they consider unsafe, excessively heavy, or otherwise unsuitable for removal with the equipment and personnel available on the day. We may also refuse to remove any Waste that we reasonably believe to be hazardous or non-compliant with waste regulations.

8. Waste Ownership and Regulations

8.1 By presenting Waste for collection, the Customer warrants that they are the owner of the Waste or are otherwise authorised to arrange for its removal. Ownership of the Waste transfers to Waste Collection Sutton at the point it is loaded onto our vehicle, except for any items that we decline to accept.

8.2 Waste Collection Sutton will manage the Waste in accordance with all applicable UK waste management laws and regulations, including duty of care obligations and requirements for transfer to appropriately licensed facilities.

8.3 The Customer agrees not to include in the Waste any items that are prohibited or require special handling under UK law, such as certain hazardous, explosive, flammable, medical, or controlled wastes, unless we have expressly agreed in advance in writing to handle such items and appropriate arrangements have been made.

8.4 Where required, a waste transfer note or other documentation shall be completed and retained in accordance with regulatory requirements. The Customer agrees to provide accurate information needed to complete such documentation.

9. Customer Warranties

9.1 The Customer warrants that:

• The information provided about the Waste is accurate and complete.

• The Waste presented for collection corresponds to the description given at the time of booking.

• There are no hidden hazards, dangerous materials, or illegal items in the Waste.

• Access to the premises and loading areas is safe and lawful.

9.2 The Customer shall indemnify Waste Collection Sutton against all claims, losses, damages, costs and expenses arising from any breach of these warranties or from any unlawful or unsafe items being included in the Waste.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded under UK law.

10.2 Subject to clause 10.1, our total liability to the Customer in respect of all losses arising under or in connection with the Contract, whether in contract, tort, negligence, breach of statutory duty or otherwise, shall not exceed the total amount paid or payable by the Customer for the specific Service giving rise to the claim.

10.3 We shall not be liable for any indirect or consequential loss, including loss of profit, loss of revenue, loss of business, loss of opportunity, or damage to reputation, whether arising directly or indirectly from the Service or from any delay or failure to perform.

10.4 We shall not be liable for damage to items or property where such damage arises from:

• The condition, fragility or unsuitability of the items or property.

• The Customer’s failure to protect or remove items from the work area.

• Inaccurate or incomplete information provided by the Customer.

10.5 Any claim by the Customer relating to damage or loss must be notified to us in writing as soon as reasonably practicable and in any event within 7 days of completion of the Service, providing reasonable details and evidence of the alleged loss.

11. Events Beyond Our Control

11.1 We shall not be in breach of the Contract or otherwise liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include, but are not limited to, extreme weather, traffic disruption, accidents, public emergencies, strikes, breakdowns, or changes in law or regulations.

11.2 Where such an event occurs, we will use reasonable endeavours to notify the Customer and to resume the Service as soon as reasonably practicable or to agree an alternative solution.

12. Complaints

12.1 If you are dissatisfied with any aspect of the Service, you should contact us promptly with details of your complaint. We will review the matter and, where appropriate, seek to resolve the issue through investigation, explanation, corrective action, or goodwill gestures at our discretion.

12.2 Making a complaint does not affect your statutory rights. However, any remedy we may offer will be subject to the limitations and exclusions of liability set out in these Terms and Conditions.

13. Data Protection and Privacy

13.1 We may collect and process personal information about Customers for the purposes of managing bookings, providing Services, processing payments, and fulfilling our legal obligations.

13.2 We will handle personal data in accordance with applicable UK data protection laws. By using our services, you consent to the collection and use of your information for these purposes.

14. Variations to These Terms

14.1 We may revise these Terms and Conditions from time to time. The version in force at the time you make your booking will apply to that Contract unless a change is required by law or regulatory authority, in which case it may apply immediately.

14.2 Updated terms may be made available upon request. It is the Customer’s responsibility to ensure they have read and understood the current Terms and Conditions before entering into a new Contract.

15. Severability

15.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful or unenforceable, such provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the provision shall be deemed deleted.

15.2 Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation, including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation.
